Terms of Service
Welcome to eResonate. By creating an account or using the network, on the website or in the eResonate app, you agree to these terms, to our Community Guidelines and to our Child Safety Standards. Please read them.
1. Your Account
eResonate is for adults. You must be at least 18 years old to create an account or to use eResonate, on the website and in the app.
How we check age. We ask about your age when you create an account, and our servers apply the same rules on the website and in the app:
- In the app, we ask Apple for your age range. You choose whether to share it.
- If your device gives no age range, in the United States and Canada we may ask for your date of birth instead. We use it once to work out whether you are 18 or over, and we do not keep it.
- Where the law requires a confirmed age, such as in the United Kingdom and some US states, we accept only an age that Apple has confirmed or that an age-check provider has verified. If we cannot confirm your age there, we cannot open an account for you.
- On the website, we ask for your date of birth. Until we work with an age-check provider, new accounts can be opened on the website only in the United States and Canada, outside the places that require a confirmed age.
If you are under 18. We do not open an account for anyone who tells us they are under 18. If an existing account tells us its owner is under 18, we suspend it until an adult age is confirmed. If we learn that an account belongs to a child under 13, we delete it. Accounts created before we asked about age will be asked to confirm their age once. Giving us a false age breaks these terms.
You're responsible for the activity on your account. We use a passwordless system with a recovery code. Keep your recovery code safe; it's how you get back into your account on a new device.
2. Acceptable Use
You agree not to:
- Post content that is illegal, harassing, hateful, or infringes someone else's rights.
- Impersonate another person, band, or venue.
- Spam, scrape, or abuse the service, or attempt to disrupt it.
- Upload malware or attempt to gain unauthorized access.
- Stream or transmit pre-recorded music of any kind, including DJ sets, backing tracks, karaoke tracks, or playback of commercially released recordings. See section 4.
We may remove content or suspend accounts that violate these terms. You can report content or block other users at any time.
Zero tolerance. eResonate has zero tolerance for objectionable content and abusive users. Above all, that means child sexual abuse and exploitation, and sharing intimate images without consent (section 8). Our Community Guidelines explain what is and is not allowed. In the app, before your first post, comment or message, we ask you to confirm that you accept this.
3. Your Content
You keep ownership of what you post. By posting, you grant eResonate a license to host and display your content on the network so the service can work. You're responsible for having the rights to what you share.
Copyright. If you believe something on eResonate infringes your copyright, follow our copyright policy. We remove material in response to valid notices, give the member who posted it a chance to respond, and close the accounts of members who repeatedly infringe.
4. Performances, Music Rights & Setlists
Where eResonate supports streamed performances, artists and venues keep 100% of the performance revenue and set their own split. Specific payout terms are provided during creator onboarding and are governed by any separate agreement you enter into with us.
Live only. Streams on eResonate are live. Performances are not recorded, stored, or replayed by eResonate, and no on-demand or archived version of a show is made available.
No pre-recorded music. Performing or transmitting pre-recorded music through eResonate is prohibited. This includes DJ sets, backing tracks, karaoke tracks, and the playback of commercially released recordings, whether by an artist, a venue, or anyone else. Streams must consist of live performance only.
Setlists are required before you can stream. Before a show can go live, the performing artist must submit a complete setlist, including cover songs, through the eResonate administrative system. Streaming capability does not unlock until a setlist is filed. After the show, the venue must confirm or correct the setlist so that it accurately reflects what was performed.
Reporting to rights societies. Confirmed setlist and performance data is made available to performing-rights organizations and other rights-management agencies so that songwriters and publishers can be paid for the works performed. By streaming on eResonate, you agree that this data may be shared for that purpose.
You represent that you hold, or are otherwise entitled to rely on, the rights necessary to perform the works in your setlist, and that your performance complies with these rules. Submitting an inaccurate setlist, or streaming pre-recorded music, may result in the loss of streaming access.
5. New-Artist Launch Bonus
For a limited launch period, eResonate pays a $1,000 bonus per qualifying show, in addition to, and without reducing, any other revenue you earn.
- Eligibility window. The first three (3) months after a musician's account is created.
- Qualifying show. A live performance streamed on eResonate that holds 8,000 or more concurrent viewers continuously for at least 20 minutes, as measured by eResonate's streaming telemetry. The test is sustained attention to the stream, not the length of the set. Viewing time counts whether the audience is watching the performance or an advertisement.
- Frequency cap. At most one bonus per artist per calendar week.
- Compliance. The show must comply with section 4: a filed and venue-confirmed setlist, live performance only, and no pre-recorded music. Shows that don't comply are not eligible.
- Payment. Bonuses are paid with your normal payout cycle to the account on file.
Concurrent-viewer and duration measurements taken by eResonate are used to determine eligibility. We may withhold a bonus where we reasonably determine that viewership has been artificially inflated or these rules have otherwise been circumvented. This is a promotional program: we may change or end it for shows not yet performed, but doing so will not affect a bonus already earned on a qualifying show.
6. Text Messages (SMS Terms)
By adding a mobile number to your eResonate account and switching on text alerts, you agree to receive text messages from eResonate Media Corporation at that number: alerts about shows you follow, and one-time sign-in codes when you ask for them. Frequency depends on how much you follow: roughly 2–8 messages a month.
Msg & data rates may apply. Reply STOP to cancel, or HELP for help. You can also switch alerts off, or remove your number, in Settings & Privacy at any time, and Show alerts by text sets out the program in full. Carriers are not liable for delayed or undelivered messages. For help, write to duke@eresonate.com.
7. The Service Is Provided "as Is"
eResonate is offered without warranties of any kind. We work hard to keep it running and safe, but we don't guarantee it will always be available or error-free. To the extent permitted by law, our liability is limited.
8. Zero Tolerance for Child Sexual Exploitation and Intimate-Image Abuse
Children. Nothing that sexually exploits, abuses or endangers a child is allowed on eResonate, in any form. That includes child sexual abuse material (images, video, drawings, generated or altered images, or text), sexualising a minor, grooming, sextortion and trafficking. Our Child Safety Standards set out how we prevent it and what we do. When we confirm it, we remove it, close the account for good, preserve the evidence as the law requires, and report it to the National Center for Missing & Exploited Children (NCMEC).
Intimate images. Do not share, or threaten to share, a nude or sexual image or video of anyone without their consent, including one that was faked or altered. The person shown, or someone authorised to act for them, can ask us to remove it through our intimate-image removal process, with or without an account. We remove it within 48 hours of a valid request and block copies of the same image from being uploaded again.
Accounts that break these rules are closed permanently, and we may stop the device used from creating or signing in to accounts in the app.
9. Reporting and Blocking
In the app, you can report a post, comment, message, profile, profile photo, group, page, show and more from the menu next to it, or from Help & Safety. On the website, use the menu next to a post or message. Anyone can report without an account, using our report form or by writing to report@eresonate.com.
Every report reaches a person on our team. We aim to review reports within 24 hours, and we look first at reports about a child's safety, a threat of violence or an intimate image. Some of these may be hidden as soon as they are reported, while we review them. We do not tell the person you reported who reported them. In the app, you can follow what happened to your reports under Your reports.
Blocking someone removes the connection between you, stops direct messages between you, and hides their posts and messages from you across eResonate, including in group chat. It takes effect at once, and the other person is not told.
10. Moderation, Automated Checks and Appeals
Our team reviews reports and may remove content, or warn, limit, suspend or close accounts that break these terms or our Community Guidelines. When we remove something of yours or act on your account, we tell you which rule it broke, unless the law or someone's safety means we cannot.
Automated checks. To keep the network safe, an automated check compares the text you write with lists of words and phrases our team maintains, and every image is checked against lists of known abuse images before anyone else can see it. Our Privacy Policy explains how. If an automated check stops something you wrote, you can edit it or ask a person to review the decision.
Appeals. You can appeal a decision about your content or your account once, within 30 days, from the notice we send you, from Your reports in the app, or through our appeals page. A person reviews it and we tell you the outcome; if we got it wrong, we reverse it. If your account was suspended because of your age, you can confirm your age instead. Anyone, with or without an account, can send us a complaint about how we handle safety through the same page.
11. Deleting Your Account
You can delete your account at any time in Settings, on the website or in the app. Deleting it erases your profile, posts, comments and messages. A few things are kept, as our Privacy Policy and Delete Your Account explain: for example, the other person keeps their copy of the direct messages you exchanged, which then show you as "Former member". A legal hold can delay a deletion. Deleting the app does not delete your account.
12. Changes & Termination
We may update these terms; we'll post changes here and update the date and version above. When a change matters, the app asks you to accept the new version before you next post, comment or send a message; reading stays open. We may suspend or terminate accounts that break these terms.
