Terms of Service
Welcome to eResonate. By creating an account or using the network, you agree to these terms. Please read them.
1. Your account
You must be at least 13 years old (or the minimum age in your country) to use eResonate. You're responsible for the activity on your account. We use a passwordless system with a recovery code — keep your recovery code safe; it's how you get back into your account on a new device.
2. Acceptable use
You agree not to:
- Post content that is illegal, harassing, hateful, or infringes someone else's rights.
- Impersonate another person, band, or venue.
- Spam, scrape, or abuse the service, or attempt to disrupt it.
- Upload malware or attempt to gain unauthorized access.
- Stream or transmit pre-recorded music of any kind — including DJ sets, backing tracks, karaoke tracks, or playback of commercially released recordings. See section 4.
We may remove content or suspend accounts that violate these terms. You can report content or block other users at any time.
3. Your content
You keep ownership of what you post. By posting, you grant eResonate a license to host and display your content on the network so the service can work. You're responsible for having the rights to what you share.
4. Performances, music rights & setlists
Where eResonate supports streamed performances, artists and venues keep 100% of the performance revenue and set their own split. Specific payout terms are provided during creator onboarding and are governed by any separate agreement you enter into with us.
Live only. Streams on eResonate are live. Performances are not recorded, stored, or replayed by eResonate, and no on-demand or archived version of a show is made available.
No pre-recorded music. Performing or transmitting pre-recorded music through eResonate is prohibited. This includes DJ sets, backing tracks, karaoke tracks, and the playback of commercially released recordings — by an artist, a venue, or anyone else. Streams must consist of live performance only.
Setlists are required before you can stream. Before a show can go live, the performing artist must submit a complete setlist — including cover songs — through the eResonate administrative system. Streaming capability does not unlock until a setlist is filed. After the show, the venue must confirm or correct the setlist so that it accurately reflects what was performed.
Reporting to rights societies. Confirmed setlist and performance data is made available to performing-rights organizations and other rights-management agencies so that songwriters and publishers can be paid for the works performed. By streaming on eResonate, you agree that this data may be shared for that purpose.
You represent that you hold, or are otherwise entitled to rely on, the rights necessary to perform the works in your setlist, and that your performance complies with these rules. Submitting an inaccurate setlist, or streaming pre-recorded music, may result in the loss of streaming access.
5. New-artist launch bonus
For a limited launch period, eResonate pays a $1,000 bonus per qualifying show — in addition to, and without reducing, any other revenue you earn.
- Eligibility window. The first three (3) months after a musician's account is created.
- Qualifying show. A live performance streamed on eResonate that holds 8,000 or more concurrent viewers continuously for at least 20 minutes, as measured by eResonate's streaming telemetry. The test is sustained attention to the stream, not the length of the set — viewing time counts whether the audience is watching the performance or an advertisement.
- Frequency cap. At most one bonus per artist per calendar week.
- Compliance. The show must comply with section 4 — a filed and venue-confirmed setlist, live performance only, and no pre-recorded music. Shows that don't comply are not eligible.
- Payment. Bonuses are paid with your normal payout cycle to the account on file.
Concurrent-viewer and duration measurements taken by eResonate are used to determine eligibility. We may withhold a bonus where we reasonably determine that viewership has been artificially inflated or these rules have otherwise been circumvented. This is a promotional program: we may change or end it for shows not yet performed, but doing so will not affect a bonus already earned on a qualifying show.
6. The service is provided "as is"
eResonate is offered without warranties of any kind. We work hard to keep it running and safe, but we don't guarantee it will always be available or error-free. To the extent permitted by law, our liability is limited.
7. Changes & termination
We may update these terms; we'll post changes here and update the date above. You can delete your account at any time from your profile. We may suspend or terminate accounts that break these terms.
